IMBES na bumida, nagmukhang mangmang sa batas ang tambalang kongresista at abogado sa likod ng maneobrang nagsusulong “pagbakasyunin” si House Speaker Martin Romualdez at iba pang miyembro ng Kamara kaugnay ng di umano’y irregularidad sa 2025 General Appropriations Act
Ang dahilan – ibinasura ng Office of the Ombudsman ang petisyon para sa preventive suspension na hirit ni Davao del Norte Rep. Pantaleon Alvarez at Atty. Ferdinand Topacio laban kay Romualdez, Zamboanga City Rep. Manuel Dalipe, Ako Bicol partylist Rep. Elizaldy Co, Marikina Rep. Stella Quimbo (Marikina City), at iba pang miyembro ng Technical Working Group ng Bicameral Conference Committee.
Sa 10-pahinang resolusyon, ipinahayag ni Ombudsman Samuel Martires na walang merito ang mosyon para suspindihin si Romualdez at iba pang opisyal ng Kamara lalo pa aniya’t nasa Kongreso ng eksklusibong kapangyarihan para disiplinahin ang mga miyembro — alinsunod sa mga probisyong nakapaloob sa 1987 Constitution..
Bukod kina Alvarez at Topacio, nakalagda rin sa petisyon sina Citizen’s Crime Watch president Diego Magpantay, at retired Brig. Gen. Virgilio Garcia.
“Unquestionably, the Office of the Ombudsman possesses full disciplinary authority over public officials and employees, except impeachable officials, members of Congress, and the Judiciary. Since respondents are members of the House of Representatives, this Office does not have the authority to order their suspension,” pahayag pa ng Ombudsman.
Kasama rin sa mga nagreklamo si senatorial candidate Jimmy Bondoc, na inakusahan si Romualdez at tatlong iba pang opisyal ng Kamara ng pamemeke ng legal documents, at paglabag sa Anti-Graft and Corrupt Practices Act (RA 3019), sa umano’y P241-bilyong halaga ng mga insertions sa 2025 budget bill.
Nilinaw na ni Quimbo, na may mahalagang papel sa deliberasyon ng budget, na ang mga blangkong bahagi sa reklamo ay inilaan para sa mga technical staff upang gumawa ng kinakailangang pagsasaayos. Wala na rin aniyang diskresyon ang mga mambabatas na baguhin ang mga halaga sa naturang yugto.
Ipinag-utos ni Martires na pansamantalang ihinto ang pagtalakay sa reklamo dahil sa nakabinbing petisyon sa Korte Suprema na inihain nina Davao City Rep. Isidro Ungab, Atty. Victor Rodriguez, at iba pa na kumukuwestiyon sa konstitusyunalidad ng 2025 General Appropriations Act (RA 12116).
“After a careful reading of the complaint, I am convinced that the issues raised herein are closely intertwined, if not, intimately related to a Petition for Certiorari and Prohibition that was earlier filed before the Supreme Court,” pahayag ng Ombudsman.
“The Supreme Court must first resolve the issue of constitutionality before the criminal action pending before the Ombudsman will proceed. Whatsoever will be the resolution of the Supreme Court in the Petition for Certiorari and Prohibition would be determinative juris et de jure of the guilt or innocence of herein respondents in the criminal case before the Ombudsman,” paliwanag ni Martires.
Dagdag pa niya, kung paninindigan ng Korte Suprema ang pagiging balido ng 2025 budget law, mawawalan ng probable cause para sa anumang kasong kriminal.
“Indeed, there is a prejudicial question that necessitates suspension of the criminal proceedings until such time that the Special Civil Action has been resolved with finality by the Supreme Court,” saad pa ng Ombudsman. (ROMEO ALLAN BUTUYAN II)
