SA isang komplikadong proseso, higit na angkop ang personal na pagdalo ng mga senator-judges sa mga pagdinig na isasagawa ng impeachment court — gayundin sa pagboto pabor man o kontra sa pagpapatalsik sa akusadong opisyal ng gobyerno.
Sa isang kalatas, nagpahayag ng pagtutol si House Committee on Justice Chair at lead prosecutor Gerville “Jinky Bitrics” Luistro sa mungkahing pahintulutan ang ibang senator-judges na lumahok sa pagdinig at bumoto sa bisa ng online platform.
“My humble submission about this issue is dapat personal na nasaksihan ng senator-judge ang trial at dapat personal din siyang boboto dahil napakahalaga ng prosesong ito,” wika ni Luistro.
Ginawa ng House lead prosecutor ang pahayag matapos na ipalutang sa Senado ang posibleng pagpapahintulot kay Sen. Ronald “Bato” dela Rosa na maging bahagi ng impeachment proceedings gamit ang Zoom teleconferencing.
Si Dela Rosa, na kilalang kaalyado ng mga Duterte, ay kasalukuyang nagtatago sa mga awtoridad dahil sa arrest warrant na inilabas ng International Criminal Court (ICC) matapos na tukuyin bilang co-perpetrator sa kasong crime against humanity na isinampa laban kay former President Rodrigo Duterte bunsod ng madugong giyera kontra droga.
“Napakahalaga po na personal na nakikita ng senator-judge ang bawat testigo. Napakahalaga po na personal na nakikita ng bawat senator-judge ang bawat papel, video na inilatag in support of the Articles of Impeachment,” pagbibigay-diin ni Luistro.
Ayon pa sa ranking House official, mainam na personal na obserbahan ng senator-judges ang kilos o galaw ng mga testigo habang nakasalang sa impeachment trial para timbangin ang kredibilidad ng mga tatayong saksi sa pagdinig.
Nagbabala rin si Luistro sa magiging implikasyon kung papayagan ang remote participation sa magiging kahihinatnan ng impeachment complaints.
Maging si former Surigao del Norte Congressman Robert Ace Barbers ay nagpahayag ng pagtutol na amyendahan o baguhin ang internal rules ng Impeachment court para lang payagan makadalo at bumoto ang partikular na senator-judge kahit naka-online lang.
“The proponents want this amendment to extend to the Impeachment Court internal rules. This proposal betrays the intention of some members to accommodate other members who may not be able to physically attend sessions, not due to medical reasons but in anticipation of their absence in relation to the cases that they may be facing or about to face,” ayon kay Barbers.
“Obviously, some Senators want to protect the others and use the latter’s predictable inclinations in furtherance of their agenda, without regard to the still to be presented solid evidence. The proponents are banking on the present majority composition which is aligned with the members who are subject of the proposal,” dagdag Barbers.
Paalala ang Mindanaoan lawmaker sa Senado, sagrado ang proseso ng impeachment trial.
“The importance of an impeachment trial is for the Senator-Judges to see and hear in person all evidence and witnesses to be presented so as to enable them to properly appreciate the presentations of the prosecution and the defense,” giit ni Barbers.
Sa pamamagitan naman ng physical examination ng mga dokumento at iba pang material evidence, maging ang personal at aktwal na pagkilatis at pag-obserba sa mga testigo ay makakatulong para makabuo ng matalinong desisyon batay sa katotohanan, ebidensya, testimonya at argumento.
“Actual and active physical participation in the trial is the kind of respect due the Impeachment Court. If the Senator-Judge respects the processes and the sanctity of the trial, he must take it upon himself to attend physically. He owes it to the people to discharge his duty and responsibility in the best manner. The only exception should be for medical reasons,” pananaw pa ni Barbers.
