NAHAHARAP si Mayor Abby Binay sa dalawang magkahiwalay na kasong kriminal at sibil kaugnay ng naunsyaming Makati Subway Project at pagkandado ng pasilidad 10 EMBO barangay na sakop ng Taguig City.
Unang kakaharapin ni Abby ang kasong paghahabol ng Philippine InfraDev Holdings Inc., kontratista ng pumalpak na $3.5 bilyong Makati Subway Project na inihain sa Singapore International Arbitration.
Hiniling ng Infradev sa international arbitration na ibalik ng Makati City ang P44 bilyon na nagastos sa Makati City Subway Project bago pa man nahinto sanhi ng desisyon ng Supreme Court sa jurisdiction ng 10 enlisted men’s barrios (EMBO).
“Continuing with the Makati City Subway Project under the joint venture agreement with the city government was rendered no longer economically and operationally feasible due primarily to the Supreme Court’s decision declaring some subway stations and depot to be under the jurisdiction of Taguig,” ayon sa Infradev.
“Arbitration proceedings have thus commenced with the Singapore International Arbitration Centre to enable an impartial resolution of the agreement with Makati,” dagdag ng korporasyon.
Ayon sa auditor ng kumpanya, PwC, nalugi ang InfraDev ng P44 bilyon sa proyekto – P39 bilyon sa pagbili ng 8, 413 ektarya ng lupain noong 2024 na ngayon nasa hurisdiksyon ng Taguig City at P5 bilyon sa development cost tulad ng architectural design at master plan ng subway.
Kasabay nito, naghain naman ng kasong kriminal at administratibo sa Office of the Ombudsman sina Emilyn Borromeo Cacho at Johanna Gallardo Junio laban kay Binay sa pagsasara ng mga pasilidad sa 10 EMBO barangay matapos magpasya ang Korte Suprema sa hurisdiksyon ng nasabing lugar.
Base sa kasong inihain nina Cacho at Junio sa Ombudsman, nilabag ni Binay ang Section 3 (e) ng Republic Act No. 3019, Section 4 ng Republic Act No. 6713, Grave Misconduct and Conduct Prejudicial to the Best Interest of the Service, at Article 231 ng Revised Penal Code.
Residente si Cacho ng Barangay South Cembo, Taguig City at si Junio naman sa Barangay East Rembo sa naturang lungsod na nagreklamo dahil hindi nila nagamit ang pasilidad na itinayo gamit ang buwis ng mga mamamayan.
‘The health centers and clinics, day care centers, multi-purpose facilities, and sports and recreation centers, all essential and indispensable for the delivery of basic services for the EMBOs, were unlawfully shut down upon the malicious and whimsical order of respondent Binay-Campos,” ayon sa kasong isinumite sa Ombudsman.
Aniya, malinaw na ipinagkait sa kanya ang serbisyong medikal sa health center ng Barangay South Cembo dahil isinara ni Binay. Natigil din aniya ang pag-inom ng kanyang maintenance medicines.
“When respondent Binay-Campos arbitrarily ordered the closure of the health center in Barangay South Cembo, Taguig, she went for months without taking her maintenance medication as she could not travel far on account of her dire health condition,” giit ni Cacho.
Sinabi naman ni Juino na isa siyang cancer survivor na hindi nakagamit ng mga pasilidad ng East Cembo dahil isinara ng alkalde, sukdulang pagkaitan ang ilang vulnerable sector tulad ng senior citizen, buntis, persons with disabilities at sinumang may problemang pinansyal na lubhang apektado ng illegal na pagkilos ng alkalde.
“Respondent should not have closed and /or controlled the government offices and facilities, especially the East Rembo Health Center and Ospital ng Makati (OsMak), since they are constructed for the use of EMBO residents, using the taxes of the people therein,” giit ni Junio.
“In view of the foregoing, complainants pray that the Honorable Office: (a) PREVENTIVELY SUSPEND respondent Binay-Campos; (b) find her administratively guilty of violating RA 6713 and committing grave misconduct and conduct prejudicial to the best interest of the service and impose the appropriate penalties; and (c) find probable cause for violating Sec. 3e of RA 3019 and Art. 231 of the Revised Penal Code and thus indicting her in court,” ayon sa reklamo.
