KUMBINSIDO ang lupon ng tagausig na mas mapapatibay ang alegasyon kung papayagan ng Senate impeachment court ang pagharap ng lima pang testigong magpapatotoo sa maling paggamit ni Vice President Sara Duterte sa confidential funds na inilaan sa kanyang tanggapan. Bilang tugon sa mosyon na inihain ni lead prosecutor Gerville Luistro, kinatigan ng senate impeachment court ang hirit na isyuhan ng subpoena ang lima pang indibidwal. Kabilang sa mga ipapatawag ng korte sina former Department of Education (DepEd) special disbursing officer (SDO) Edward Fajarda, DepEd Assistant Secretary Sunshine Charry Fajarda, Philippine Statistics Authority (PSA) Assistant National Statistician Marizza Grande, Police Maj. Jovelyn Magay, at Commission on Audit (COA) officer Bresilio Sabaldan. Sina Magay at at Sabaldan ay kapwa nasa reserved witnesses list na unang natukoy sa pretrial brief at sakop ng pretrial order. Sa direktiba ng korte, ipinag-utos ang pagharap ng limang indibidwal sa pagdinig na isasagawa sa Setyembre 7, 8 at 9. Pag-amin ni Luistro, pinag-aaralan ng prosekusyon ang posibilidad na hindi na paharapin sa impeachment trial si Fajarda dahil na rin sa kasalukuyang medical condition nito. “Concerning, Your Honor, witness Mr. Edward D. Fajarda, we would like to manifest that we completely understand, and in fact sympathize, and express our concern on his medical condition,” ani Luistro. “It is our intention not to aggravate his condition. As a matter of fact, it is likewise our intention to excuse him, if possible, from the rigors of being presented in the witness stand. However, Your Honor, that is without sacrificing the case of the prosecution,” dagdag niya. Si Fajarda ang nagsilbing DepEd SDO para sa P112.5 million confidential funds na ginasta sa tatlong P37.5-million tranches noong 2023.
