PARA kay Senador Alan Peter Cayetano, taliwas sa mandato ng Department of Justice (DOJ) ang ginawang pagkilos at paghawak ng awtoridad sa paghahain ng warrant of arrest laban kay former President Rodrigo Duterte.
Sa isang pahayag, partikular na tinukoy ni Cayetano ang umano’y kabiguan ng DOJ na idaan sa tamang proseso ang pagdakip sa dating pangulo sa bisa ng warrant of arrest na inilabas ng International Criminal Court (ICC).
Hindi rin aniya angkop ang ginawa ng Department of Interior and Local Government (DILG) sa paraan ng pag-aresto kay Duterte.
“Every single Filipino deserves due process,” ani Cayetano sa pagdinig ng Senate Committee on Foreign Relations na punong abala sa “congressional investigation in aid of legislation” kaugnay ng insidenteng gumimbal sa bansa.
Tinanong ng senador kung nasunod ba ang due process bago ipinasakamay ng gobyerno si Duterte sa foreign authorities.
“Doesn’t a Filipino citizen have the right under the Constitution to be judged first by Philippine law before being brought to a foreign country or an international tribunal to face their interpretation of the law?” aniya.
Binigyang diin ni Cayetano ang mga pangunahing proteksyon sa ilalim ng Konstitusyon, partikular na ang karapatan ng akusado na magkaroon ng legal na kinatawan at remedyong legal sa korte sa Pilipinas bilang bahagi ng due process.
“Any person under investigation for the commission of an offense shall have the right to be informed of his right to remain silent and to have competent and independent counsel, preferably of his choice,” aniya.
Pinuna rin ni Cayetano ang kakulangan ng transparency sa kasong isinampa at basehang legal sa pagsuko kay Duterte, sabay iginiit na dapat mangibabaw ang batas ng Pilipinas kapag may hindi pagkakatugma sa international law.
“It is important to be informed of the nature and cause of the accusation against him… If there’s a conflict between international law and ourConstitution, our Constitution will prevail,” aniya.
Mariin ding tinutulan ni Cayetano ang argumentong hindi na kailangang busisiin ng Senado ang isyu, lalo na’t may posibilidad na maulit ito sa iba pang opisyal ng gobyerno at militar.
“I disagree that this hearing is not important because if there’s a second, third, or fourth batch of warrants coming, I want to make sure that every officer has his day in local Court before they’re sent to The Hague,” ayon sa senador.
Binalaan niya ang publiko laban sa piling pagpapatupad ng batas, iginiit na dapat ipatupad ang due process para sa lahat.
“We as Filipinos should demand due process for everyone. Kaya mali yung argument na ‘pag ‘di mo binigyan ng due process yung kalaban, hindi ka na pwedeng mag-demand ng due process,” wika niya. “That’s the beauty of our Constitution. Everyone should be given due process.” (ESTONG REYES)
