MATULOY man o hindi ang deliberasyon ng Senate Impeachment Court sa reklamong inihain laban kay Vice President Sara Duterte, hindi pa rin lusot sa nakaambang kastigo ang pangalawang pangulo – kahit pa magbitiw sa pwesto.
Ayon kay 1-RIDER Partylist Rep. Rodge Gutierrez na kabilang sa 11-man House Prosecution Panel, may kapangyarihan ang Kongreso na patawan ng perpetual disqualification ang bise-presidente sa anumang posisyon sa gobyerno.
Pagtitiyak ni Gutierrez, hindi mawawalan ng saysay ang impeachment case, gayundin ang nakaambang parusang “perpetual disqualification from holding public office” sakaling magpasya si VP Sara na magresign bago pa man sumipa ang impeachment trial.
“The purpose of impeachment is one, removal from office, and two, the penalty of perpetual disqualification from holding a public office. And I believe resignation while it might avoid the first penalty, the second penalty is still there po,” anang abogadong mambabatas.
“I don’t think you should take away the power from the Senate impeachment court to impose that second penalty just by simple resignation,” dugtong ng partylist solon.
Pebrero 5 nang isimumite ng Kamara ang Articles of Impeachment sa Senado matapos lagdaan ng nasa 215 kongresista kung saan nakapaloob ang mga reklamong “culpable violation of the Constitution, graft and corruption and betrayal of public trust.”
Una nang tumanggi ang pamunuan ng Senado simulan ang pagdinig ng senado na tatayong impeachment court – sa kabila ng pangangalampag ng mga legal experts.
Katwiran ni Senate President Francis Escudero, nakabakasyon na ang mga mambabatas ng mataas na kapulungan ng Kongreso.
Para naman kay House Assistant Majority Leader at Lanao del Sur Rep. Zia Alonto Adiong, dapat ituloy ang impeachment trial mag-resign man o hindi ang nasasakdal.
“The process of the impeachment trial is not tied up with the resignation of the certain official na na-impeached, di ba?,” bulalas ni Adiong.
Dagdag pa niya, matapos na mai-transmit ng Kamara ang Articles of Impeachment sa Senado, obligado ang huli na agad umakto bilang Impeachment Court at desisyunan ang mga inihain sa kanilang kaso.
“The Congress in this case na-impeach si VP Sara, and automatic, the Senate will have to really convert itself into an impeachment court para mag-decide kung ano ang magiging ruling,” diin ni Adiong.
Una nang tiniyak ng bise-presidente na hindi kabilang sa kanyang plano ang pagbibitiw sa pwesto. (ROMEO ALLAN BUTUYAN II)
