ILLEGAL at unconstitutional ang paglalarawan ni Manila 3rd District Rep. Joel Chua sa kasunduan sa pagitan ni former President Rodrigo Duterte at ng China.
Bagamat walang bisa ang tinaguriang ‘gentlemen’s agreement’ sa pagitan ng dalawang lider, kumbinsido naman si Chua na yun mismo ang dahilan sa likod ng lumalalang tensyon sa West Philippine Sea.
“Kung meron pong secret deal or anong klaseng agreement iyan, assuming for the sake of argument na totoo po ito, tingin ko meron po itong Constitutional issue,” pasaring ng kongresistang abogado.
“Ito po ay illegal at unconstitutional dahil kung meron po talagang kasunduan na ganito na hindi po dumaan sa Senado or hindi sinang-ayunan ng Senado, eh kasi iyon po ang nakalagay sa ating Konstitusyon, kailangan it should be concurred by two-third votes of the Senate,” dugtong ni Chua na tumatayong vice-chairman ng House Committee on Metro Manila Development.
Giit pa ng Manila City lawmaker, “kung sila-sila lang po ang nag-usap tingin ko po eh meron pong constitutional issue dito, this is unconstitutional and void.”
Sang-ayon naman sa posisyon ni Chua si House Assistant Majority Leader at AKO Bicol partylist Rep. Raul Angelo Bongalon, sa paniwalang may “serious legal implications” ang pagkakaroon ng nasabing mga kasunduan.
“Unang-una, if this arrangement or secret deal with China is not embodied in a written agreement or treaty, therefore it is void for being unconstitutional. As mentioned under the Constitution, any international agreement or treaty must be embodied in a written agreement and must be ratified by the Senate,” ang sabi ng ranking House official.
“So, if this arrangement is not ratified by the Senate or concurred in, and therefore it is not valid. So bakit po ito may serious implications? Unang-una, ito pong arrangement na ito ay sila lang po ang nakakaalam as to the details of which the Senate, the Congress and the Filipino people were not properly informed,” dagdag pa ng kongresista.
Naniniwala si Bongalon na ang ilegal na secret deal ang naglagay sa mga Pilipinong mangingisda sa kaawa-awang sitwasyon, gayundin ang mga civilian sea vessels na biktima ng paulit-ulit na water cannon incident.
“Kailangan po natin malaman kung ano po ang mga detalye and considering that this is a temporary special arrangement at any rate at any time pwede po ito i-rescind ni Pangulong Bongbong Marcos because it is not binding to us, it is not binding in the present administration,” wika pa ng AKO Bicol partylist solon.
Samantala, binigyan-diin naman ni Chua na dapat talup[an ng Kamara ang sinasabing secret deals lalo pa’t nakataya ang seguridad ng bansa.
