KAWALAN ng sapat at matibay na ebidensya ang nagtulak sa Quezon City Prosecutor’s Office para ibasura ang kasong direct assault, disobedience, at grave coercion laban kay Vice President Sara Duterte at iba pa.
“Wherefore, in light of the foregoing considerations, the complaint for Violation of Article 148 (Direct Assault), Article 151 (Disobedience to Authority) and Article 286 (Grave Coercion), all of the Revised Penal Code, against res¬pondents Vice President Sara Zimmerman Duterte-Carpio and Col. Raymund Dante Petina is recommended to be DISMISSED for failure to sustain a finding of prima facie evidence with reasonable certainty of conviction,” saad sa resolusyon sa kasong isinampa ni Dr. Van Jayson Villamor ng Philippine National Police (PNP) Health Service.

Inirekomenda rin ang pag dismis ng reklamo laban sa iba pa – “without prejudice to re-filing once their identities and whereabouts are ascertained.”
“The alleged commission of Direct Assault, Disobedience to Authority and Grave Coercion is not supported by evidence,” diin ng prosecutor.
Paliwanag ng Office of the City Prosecutor, hindi maituturing na “attack of physical force” ang paglalagay ni Duterte ng kanyang kamay sa dibdib ng mga pulis na akmang bibitbit kay Lopez na ikinulong sa Kamara dahil sa contempt.
“The laying of hands or the use of physical force must be serious. The force exerted must be more severe than just slapping and punching. This is not the case here,” dugtong ng taga-usig.
