WALANG plano ang Department of Environment and Natural Resources (DENR) na bayaran ang P1.2-bilyong sinisingil ng Blue Star Construction and Development Corporation (BSCDC) sa di umano’y pangangalaga ng kalikasan sa Upper Marikina River Basin Protected Landscape.
Ayon sa DENR, walang legal na basehan ang paniningil ng Blue Star na di umano’y kumita ng husto sa negosyong eco-park na itinayo sa bisa ng Memorandum of Agreement (MOA) na nilagdaan ng yumaong dating Environment Secretary Gina Lopez.
Batay sa statement of account na pinadala ng Blue Star sa DENR, tumataginting na P1,186,097,554.63 di umano ang dapat bayaran ng pamahalaan para sa mga gastusin ng kumpanya mula buwan ng Hunyo ng taong 2018.
Pasok sa naturang halaga ang bayad sa abogado, mga armadong gwardya at danyos dahil sa di umano’y kabiguan ng gobyerno tumupad sa pangako – ang paggagawad ng 10-ektaryang bahagi ng lupang nakapangalan sa Bureau of Corrections (BuCor).
“This is to advise you of the following expenses incurred by Blue Star in connection with the unrealized delivery by DENR of Lot 10 OCT No 3556 pursuant to Clause 3.2 of the Joint Venture Agreement,” saad sa isang bahagi ng billing statement ng Blue Star.
Una nang sinabi ni DENR Secretary Antonia Yulo-Loyzaga na walang bisa ang MOA sa pagitan ng Blue Star at ng yumaong dating Kalihim.
Batay sa rekomendasyon ng DENR Investigation Committee, walang dahilan para maningil ang Blue Star na ginawang negosyo ang protected area.
“The contracts entered into by BSCDC (Blue Star) had legal infirmities ranging from unlawful excise of land for housing purposes in a National Park to award of contracts without bidding,” saad ng DENR Investigation Committee.
Maging ang Department of Justice (DOJ), kumbinsidong ilegal ang MOA sa pagitan ng Blue Star at ni Lopez. Ayon kay Justice Secretary Crispin Remulla, “unconstitutional” ang “perpetual land trust for conservation agreement” para sa kustodiya ng hindi bababa sa 2,700 ektaryang lupang sakop ng Baras, Tanay, Rodriguez, at Antipolo sa lalawigan ng Rizal.
“The Masungi Georeserve resort collects entrance fees from tourists (PHP1,500 per person on weekdays and PHP1,800 on weekends). It offers accommodations starting at PHP5,000 a night and hosts events like weddings and company events with rates starting at PHP120,000. The resort has a restaurant,” wika ng DENR.
“They also collect fees from tourists wanting a glimpse of the caves, stone formations, trails, rope bridges, and a spider web-like elevated platform with a 360-degree view of the Sierra Madre mountain range.”
Sa imbestigasyon ng DENR, lumalabas din na walang anumang pahintulot ang Department of Tourism sa negosyo ng Blue Star sa nasabing lugar.
