TALIWAS sa paniwala ng marami, pwedeng makalabas ng piitan si former President Rodrigo Duterte na dinampot at kasalukuyang nakakulong sa detention facility of International Criminal Court sa baybaying bahagi ng Scheveningen, sa The Hague.
Ayon kay former Supreme Court Justice Antonio Carpio, nakasaad umano sa rules of court ng ICC ang “bail provision.” Gayunpaman, hindi aniya magiging madali kay Duterte makumbinsi ang ICC lalo pat itinuturing na “flight risk” ang dating pangulo.
Isa rin aniya sa maaring gawin ng dating pangulo ang maghain sa pre-trial chamber ng isang petisyon naglalayong kwestyunin ang legalidad ng pag-aresto.
“He will appear before the pre-trial chamber and the charges against him will be reconfirmed. He will again be informed na ito yung charges… If he wants to question the validity of the order of arrest by the ICC, he can file another motion asking for reconsideration,” wika ni Carpio sa isang panayam sa programang Agenda ng Bilyonaryo News Channel.
“Yun ang pwede niyang magawa agad, to question the order of arrest by the ICC,” dugtong ng retiradong mahistrado.
“The ICC rules allow for the accused to ask for bail in very special circumstances pero mahihirapan siya dahil ano, he’s a flight risk eh. He doesn’t even want to honor the warrant of arrest. So that means, a flight risk. I doubt if it can be granted,” aniya.
Sakaling pagbigyan, baka hindi payagan si Duterte lumabas sa The Hague.
