SA pagnanais palakasin ang hanay ng tagausig, kinokonsidera ng Kamara ang pagkuha ng mga pribadong abogadong makakatuwang ng House prosecutors sa sandaling umarangkada ang impeachment trial sa senado.
Sa isang kalatas, ibinahagi ni House Justice Committee Chairperson Gerville Luistro ang paghahanda sa inaasahang paglarga ng pagdinig ng Senado sa impeachment case laban kay Vice President Sara Duterte.
“Kung matutuloy man tayo to be one of the panel of prosecutors, I will really recommend that we engage private prosecutors to help and aid the members of the House who will be joining the panel of prosecutors,” ayon kay Luistro.
Sinabi ng lady House panel chair na sa pagharap sa Senate impeachment court, kailangan ang “specialized combination” ng legislative experience at active courtroom expertise para mahusay na maipresenta ang reklamo at arhumento kontra sa pangalawang pangulo.
“Itong mga kasama natin lawyers and even myself dito sa House of Representatives, hindi na kami updated about litigation. Tapos yung makakalaban namin na defense team, sila mga litigation lawyers talaga. Although under the rules, hindi naman ipinagbabawal kumuha ng private prosecutor,” dagdag niya.
Ani Luistro, sa formal structure ng prosecution side, nakasaad sa rules ang pagtatalaga ng 11 public prosecutors, habang bukas na naman sa dami ng kukuning private lawyers.
“About the private prosecutor, the rule is silent. So, I guess it will depend on us and on the private lawyers who are willing to help the House of Representatives in the prosecution of this impeachment case,” anang kongresista.
Para naman sa 11-member panel of prosecutors, sinabi ni Luistro ay ito ay pagbobotohan sa plenaryo, kahalintulad aniya sa paghirang ng committee chair at committee members.
“Hindi automatic ‘yan. It is by way of election of the Plenary that the members become prosecutors,” saad niya.
Aminado si Luistro na wala pang katiyakan kung mapapasama siya sa hanay ng public prosecutors dahil sa ngayon ay tinututukan umano muna niya ang pagdepensa sa plenaryo ng isusumite nilang committee report at articles of impeachment.
“Medyo mabigat pa ang paparating na trabaho which is the approval of the committee report, the articles of impeachment. At pagdating dito syempre sa floor, sa plenary, I’m anticipating a heated debate dito before we finally vote on whether to transmit or not these articles of impeachment.”
