SA kabila ng kakaibang pananaw ng ilang senator-judges, mananatili ang respeto ng tagausig sa senado bilang impeachment court, ayon kay Atty. Lorna Kapunan na kabilang sa lupon ng tagausig.
Humingi rin ng paumanhin si Kapunan sa anuman ang naging reaksyon ng prosekusyon sa tinuran ni Senator-Judge Robin Padilla.
“The prosecution respects the senator-judges and apologized if any reaction from the prosecution panel during the proceedings was perceived otherwise,” wika ni Kapunan
“We’re very appreciative that Senator Robin (Padilla) always brings color and surprise and excitement. There was really no intent to disrespect him,” dugtong ng abogada.
Sa panig ni Batangas Rep. Gerville Luistro, malaking hamon para sa lupon ng tagausig na higit pang patunayan at pagtibayin ang inilalatag na mga alegasyon laban sa nasasakdal na si Vice President Sara Duterte dahil sa tila pakikipagtunggali sa impeachment trial.
“With all due respect kay Senator-Judge Robin Padilla, apparently this impeachment trial is adversarial,” ani Luistro.
“Kaya merong prosecution is to establish the case. Kaya may defense is to defend the innocence of the respondent. So, it is very much anticipated that the prosecution is biased towards presenting the case, presenting the evidence,” paliwanag ng Batangas lawmaker.
Tahasang sinabi ni Luistro na mas nakapagtataka kung sa nasabing paglilitis ay maging neutral silang nasa panig ng tagausig at higit pang katakataka kung ipagtanggol ng prosekusyon ang kinasuhan.
Aniya, sa hanay ng senator-judges ang siyang dapat at inaasahang maging patas o neutral, hindi ang dalawang panig na humarap sa kanila.
“The judge must be the one who is neutral. ‘Yung siguro sinasabing dapat neutral, that applies to senator-judges,” dagdag ni Luistro.
Paalala naman ni Deputy Speaker at Iloilo Rep. Janette Garin, ang Kamara ang siyang umaaktong prosecutor matapos na maideklarang sufficient in form and substance at suportado ng matibay na batayan ang impeachment charges.
Patunay nito ang pagkatig ng nasa 257 House members para i-impeach si Duterte at ipadala sa Senate court ang Articles of Impeachment, na siya ngayong pinagtatagisan ng prosekusyon at depensa.
“The neutral ay ang senator-judges kasi kailangan nilang pakinggan, i-analyze, pag-aralan, pagdebatehan ang lahat na related sa kaso para magdesisyon. The prosecution’s duty is to prove the charges, while the defense’s role is to defend the respondent.”
