PARA sa isang dekampanilyang abogado, obligado si Pangulong Ferdinand Marcos Jr. na palayain si Mary Jane Veloso na nakulong sa loob ng halos 15 taon sa Indonesia sa kasong drug smuggling.
Katwiran ni Atty. Romulo Macalintal, wala naman aniyang kasong kinakaharap sa bansa si Veloso – at hindi rin aniya pwedeng pairalin sa bansa ang pasya ng hukuman ng Indonesia.
“Whatever benefits the Philippine government will give to Veloso will be in line with the spirit of the transfer agreement, particularly to ‘facilitate the successful reintegration of sentenced persons into society’,” paliwanag ng abogado.
“But, in the meantime that such action has not yet been done by the president, Veloso should be released from custody of any government agency since she is not facing any charges here in the Philippines and the fact that not even a warrant of arrest has been issued against her by any court in the Philippines,” dugtong ni Macalintal.
Una nang naglabas ng pahayag ang Palasyo sa posisyon ni Marcos. Anila, pinag-aaralan pa ng mga legal experts ng gobyerno ang kaso ni Veloso kaya malayo pa umanong pag-usapan ang isyu sa clemency nito.
Ngunit ayon kay Macalintal, nakapaloob sa 2010 Department of Justice Circular No. 90, ang mga patakaran sa implementasyon ng pag-transfer ng sentensiyadong tao at malinaw na nakasaad dito na: “Only the sentencing State may, pursuant of its Constitution and laws, grant pardon, amnesty or commutation of the sentence. The administering State may, however, request the sentencing State to grant pardon, amnesty or commutation of the sentence by submitting an application with sufficient grounds.”
