PALAISIPAN sa mga botante ng Zambales kung paano mailuluklok sa pwesto ang pambato ng mga katutubo sa kung wala sa balota ang pangalan ang Aeta leader na kandidato sa posisyon ng gobernador.
Ito ay matapos maglabas ng direktiba ang Korte Suprema sa Commission on Elections (Comelec) na tanggapin ang certificate of candidacy (COC) sa pagka-gobernador ng Zambales si Chito Bulatao Balintay na pambato ng mga katutubong Aeta para gobernador ng lalawigan ng Zambales.
Ayon sa Korte Suprema, dapat isama sa balota ang pangalan ni Balintay sa talaan ng mga kandidato sa posisyon ng gobernador.
Sa bisa ng desisyon ng mga mahistrado, ganap na binaligtad ng ang desisyon ng Comelec na nagbasura sa kandidatura ni Balintay.
Ayon pa sa Korte Suprema, labis na inabuso ng Comelec sa nang tanggihan ang COC na isinumite ng lider-katutubong naghain ng kandidatura 25 minuto bago ang takdang deadline sa paghahain ng Certificate of Candidacy noong Oktubre ng nakalipas na taon.
“The SC ruled that the Comelec gravely abused its discretion when it did not allow Balintay to file his COC. It held that the Comelec should re-examine whether its rules serve the interest of justice and fair play,” saad ng Korte Suprema.
“The SC has recognized that elections are not conducted under laboratory conditions – the Comelec must be prepared to make quick decisions in response to unforeseen circumstances that could undermine or subvert the will of the voters. Given these considerations, along with Balintay’s unique circumstances, the SC found that the Comelec’s strict application of its rules was unjustified, warranting the reversal of its decision.”
