TALIWAS sa karaniwang pagkakaunawa sa probisyong nakapaloob sa 1987 Constitution, hindi nakapako sa 16 na boto ang kailangan para patalsikin sa pwesto ang isang impeachable official.
Sa isang panayam, naniniwala si House lead prosecutor Gerville Luistro na pwedeng ibaba sa 14 boto na lang ang kailangan para tuluyang sipain si Vice President Sara Duterte sa bisa ng impeachment kung ang pagbabatayan ay kasalukuyang bilang ng mga aktibong senador.
Aniya, meron na lang 22 senador ang gaganap bilang hukom. Partikular na tinukoy ng kongresista ang pagtatago ni Senador Ronald “Bato” Dela Rosa na target ng manhunt bunsod ng kinakaharap na kaso, at si Sen. Jinggoy Estrada na nakakulong matapos madawit sa flood control scandal.
“Following the doctrine of Avelino vs. Cuenco and anchoring the same further, dun sa need to truly represent the people, it should be 2/3 of 22. Right now ha, right now,” paliwanag ni Luistro.
Alinsunod sa probisyon ng 1987 Constitution, 2/3 ang kailangan boto para mahatulan ang impeachable official. Sa 22, lumalabas na 14.5 ang kumakatawan sa 2/3.
“Of course, we submit na ito ay usapin ng Senado. But kung hindi sila magkasundo-sundo, I believe that this is a justiciable issue kasi yung 2/3 of all members of the Senate nakapaloob talaga sa ating Konstitusyon,” ani Luistro.
“So it should be the Supreme Court who should pronounce kung ano talaga ang tamang numero for the purpose of conviction considering that there are members who are outside the coercive power of the Philippine Senate,” dugtong ng mambabatas.
“Ito po ang sa atin. Bakit ba tayo may mga senator? The purpose is to represent the Filipino people. So kung ang ating senator ay nakakulong, kung ang ating senator ay nagtatago, kung ating senator ay nasa labas ng bansa, can we truly say that on that particular occasion they are representing the interests of the sovereign Filipino people? Of course the answer is no.”
