MATAPOS suriin ang petisyon na inihain ng House prosecution panel, sinang-ayunan ng Senate impeachment court ang hirit na ipa-subpoena ang financial records ni Vice President Sara Duterte.
Kabilang sa mga dokumentong saklaw ng pasya ng impeachment court ang bank transaction records, Anti-Money Laundering Council (AMLC) report at tax documents ng bise-presidente, kabiyak na Atty. Manases Carpio at mga negosyo ng mag-asawa.
“After a careful examination requested, the Court finds that the requested documents meet the requirements set forth above. They are reasonably described, readily identifiable, prima facie relevant and material to the allegations under Article 2,” saad sa desisyong binasa ni impeachment court presiding officer Francis Escudero.
Ayon kay Escudero, hindi na bago sa impeachment court ang pagsusuri ng financial record ng isang akusado. Katunayan aniya, ganun din ang ginawa ng senado nang isalang sa paglilitis ang yumaong Supreme Court Justice Renato Corona.
“In granting that request, the Court cited Section 2 of Republic Act No. 1405, which expressly recognizes “cases of impeachment” as an exception to the confidentiality of bank deposits, and the rights to privacy of depositors.”
Nagbigay pahintulot din ang impeachment court ipakuha ang financial records mula 2007 hanggang 2021, kasabay ng pagbasura sa argumento ng depensa.
Anang mga abogado ng pangalawang pangulo, ang mga sinasabing records ay mga ‘prior team’ records na pwede lamang gamitin kung may bagong impeachable offenses.
Pinayagan din ng korte ang pagsusuri sa bank records ng asawa ni Duterte dahil ang financial record kasal si Carpio sa pangalawang pangulo.
“The law is clear on the matter. The legal necessity of examining the financial records of Atty. Carpio is firmly cemented by the default property regime of absolute community of property governing his marriage to the Respondent.”
Pinaboran din ng korte ang request ng prosekusyon na mag-isyu ng subpoena sa iba’t banking institutions at ng AMLC report sa mga negosyo at deposito sa bangko ng mag-asawa.
Samantala, ibinasura ng impeachment court ang hirit ng prosekusyon na kalkalin ang records ng JTC Group of Companies Philippines, Inc. at Pikimong Pikimong Philippines Corporation.
