HABANG nag-aayuno ang mga mananampalataya ng katolikong simbahan, magiging abala ang mababang kapulungan sa mga pagdinig sa impeachment complaints laban kay Vice President Sara Duterte — kesehodang Semana Santa.
Sa bisa ng House Resolution 892 na akda nina House Speaker Faustino Dy III at Majority Leader Sandro Marcos, inatasan ang House Committee on Justice na magsagawa ng pagdinig sa impeachment complaints na inihain laban kay Duterte kahit naka-Lenten break ang Kongreso.
Sa ilalim ng naturang resolusyon, binigyan din ng kapangyarihan ang Justice panel ipatupad ang Section 8 ng Rules of Procedure in Impeachment Proceedings, partikular ang mga probisyon tungkol sa pagbibigay ng karampatang proteksyon sa mga naghain ng reklamo at testigo.
“The House may, upon proper petition, provide adequate protection to a complainant or witness if it is shown that the personal safety of the complainant or witness is in jeopardy because of participating in the impeachment proceeding,” saad sa Section 8 ng Rules of Procedure in Impeachment Proceedings.
Marapat lang din anilang tiyakin ang kaligtasan ng bawat indibidwal na magiging bahagi ng pagdinig, lalo ang usapin ay kinabibilangan ng mga testimonya at ebidensya na may kaugnayan sa high public officials na maaaring maglagay sa complainants at witnesses sa “threats, intimidation, harassment, or retaliation.”
“The resolution recognizes that protecting participants is necessary to encourage the truthful disclosure of relevant information” and to preserve the integrity of the proceedings.”
Ang HR 892 ay nagpapatibay din sa exclusive power ng Kamara, batay na rin sa itinataguyod ng Saligang Batas.
“Such authority shall be exercised consistent with the Constitution, existing laws, the Rules of the House of Representatives, the Rules of Procedure in Impeachment Proceedings, and the requirements of due process,” wika ng House Speaker at Ilocos Norte lawmaker.
Nakapaloob din sa HR 892 na ang Justice committee ay maaaring makipag-ugnayan sa Department of Justice (DOJ), Philippine National Police (PNP), at National Bureau of Investigation (NBI) para sa pagsasailalim sa protective custody ng mga complainant at witness.
Binibigyan din ang House panel na magtakda o baguhin ang hearing schedules, magkaroon ng confidentiality protocols at magpasya sa internal guidelines para sa maging epektibo ang implementasyon nito ng witness protection measures.
“All actions, orders and processes issued by the committee during the recess will remain valid and enforceable, with proceedings deemed as acts of the House in the exercise of its constitutional power to initiate impeachment cases.”
“Nothing in this Resolution shall be construed to diminish or impair the constitutional rights of respondents in impeachment proceedings, the requirements of due process, or the constitutional prerogatives of the House of Representatives under Article XI of the Constitution.”
