
TULAD ng inaasahan, sumipa na ang bakbakan sa husgado sa pagitan ng kompanyang pagmamay-ari ng sentensyadong dating kongresista at mga original host ng paboritong noontime show, kaugnay ng karapatan sa paggamit ng titulong ‘Eat Bulaga’ sa programa sa telebisyon.
Sa reklamong inihain nina Tito Sotto, Joey de Leon at Vic Sotto (mga orihinal na host ng Eat Bulaga!) sa Marikina Regional Trial Court, inakusahan ng “copyright infringement” ang Television and Production Exponents, Inc. (TAPE, Inc.).
Dawit din ang GMA sa asuntong “copyright infringement and unfair competition” sa ilalim ng Republic Act 8293 na isinampa ng TV host-comedians.
“You are hereby required, within thirty (30) days after service of this Summons, to file with this court and serve on the plaintiffs, through counsel, your Answer to the Complaint,” saad sa isang bahagi ng kalatas na ipinadala ng husgado sa TAPE Inc at GMA.
“You are reminded of Rule 2, Section 4 of the 2020 Revised Rules of Procedure for Intellectual Property Rights Cases which proscribed the filing of a motion to dismiss except only on the ground of lack of jurisdiction over the subject matter, litis pendentia, or res judicata, and instead allege any ground/s other than the ones previously mentioned as defense/s in the Answer.”
“If you fail to answer within the time fixed, the court, on motion of the plaintiffs, or motu proprio, render judgment as may be warranted by the allegations in the complaint, as well as the affidavits and other evidence on record.”
