YAMAN din lang inako na ni former President Rodrigo Duterte ang responsibilidad sa malawakang patayan sa giyera kontra droga sa ilalim ng nakalipas na administrasyon, hiniling ng isang lady solon sa quad comm na maglabas ng rekomendasyon nagtutulak sampahan ng kasong murder ang dating pangulo.
“By Mr. President’s own admission of his accountability both to legal and illegal actions of the police, it is the humble submission of this representation, Mr. Chair, that the quad comm is ready to make a recommendation for the filing of the necessary action in court that is a violation of the law RA 9851 Act Defining and Penalizing Crimes Against International Humanitarian Law or at the very least the murder cases as defined under the revised penal code,” wika ni Luistro sa pagdinig ng komite.
Sa datos ng Philippine National Police (PNP), nasa 6,252 ang nasawi sa mga police anti-drug operation hanggang Mayo 2022. Pero sa datos ng mga human rights group, posibleng umanong pumalo sa 30,000 ang bilang ng mga biktima ng extrajudicial killings (EJK).
Kabilang aniya sa mga nasawi ang daan-daang human rights at environmental defenders, mamamahayag, mga abogado at hurado, bukod pa sa 28 mayor at vice mayor na pinaslang hanggang noong Disyembre 2021.
“Mr. President, my question is, when you implemented the war on drugs, did you strictly comply with the requirement of due process?” tanong Luistro sa dating pangulo.
Tugon naman ni Duterte sa Batangas congresswoman — “Yes.”
Gayunpaman, agad na kinontra ni Luistro si Duterte — “Contrary to the answer of the former President, I humbly believe that the former president and his war on drugs never complied with the requirements of due process.”
“If, indeed, they followed the requirement of due process, wala po dapat ganito karaming patay at ang dapat maraming kaso na pending in court,” giit ni Luistro.
Sa ilalim ng RA 9851 of 2009, may kalakip na parusa ang sinuman nasa likod ng krimen laban sa international humanitarian law, genocide at iba pang crimes laban sa humanity kasama na ang EJK.
