
SA kabila ng Supreme Court ruling na pumapabor sa Taguig, hindi pa pwedeng kontrolin ng naturang lungsod ang 10 barangay na pasok sa teritoryong dating sakop ng Makati City.
Ayon kay Makati City Administrator Claro Certeza, malinaw na kailangan muna ng Taguig na kumuha ng ‘Writ of Execution’ bago tuluyang i-take over ang 10 barangay na may sakop sa Bonifacio Global City – batay na rin aniya kalatas ng SC.
Bilang patunay, ipinamahagi ni Certeza ang kopya ng dokumentong pirmado ni Makati Regional Trial Court Branch 64 Executive Judge Gina Bibat-Palamos, kung saan bahagi ng kalatas ang sagot ng SC kaugnay ng “transfer of jurisdiction.”
“As an initial assessment, the decision of the Supreme Court’s Third Division should be the subject of a Writ of Execution before the trial court of origin. When the said writ has been implemented by the Department of Interior and Local Government, then that is the reckoning period for the transfer of jurisdiction of cases emanating from the Fort Bonifacio Military Reservation, consisting of Parcels 3 and 4, Psu-2031, from Makati City to the City of Taguig,” saad ni SC Administrator Raul Villanueva sa naturang dokumento.
“All cases currently filed and pending before the first and second level courts in Makati City should continue to be tried, heard, and decided by the said courts.”
Para kay Certeza, masyadong minamadali ng Taguig ang proseso nang hindi alintana ang umiiral na batas bago pa man inilunsad ang taunang Brigada Eskwela sa Makati Science High School at ang pagbisita sa Fort Bonifacio Elementary School at Fort Bonifacio High School – na bahagi ng pinag-aagawang teritoryo.
“Their unlawful entry in our public schools without securing the necessary legal processes clearly demonstrates a lack of respect for established procedures and the principle of jurisdiction,” banat pa ni Certeza.
Babala pa ng Makati administrator, pinag-aaralan na rin nila ang pagsasampa ng kasong administratibo bunsod ng aniya’y “for its unlawful attempt to take possession of properties owned by Makati.”
Samantala, pinawi ng Commission on Elections (Comelec) ang agam-agam ng mga residente ng mga naturang barangay kaugnay ng nalalapit na halalan.
Ayon kay Comelec chairman George Garcia, madali lang naman aniyang ilipat ang database ng Makati sa bagong nagmamay-ari sa 10 barangay.
