PINAWALANG-SALA ng hukuman ang dating hepe ng National Bureau of Investigation legal assistance office at kapatid na kawani ng Bureau of Immigration (BI) sa patong-patong na kasong isinampa ng pangunahing suspek sa likod ng kontrobersyal na “Pastillas Scam.”
Sa inilabas na hatol ng Manila Regional Trial Court – Branch 18, abswelto si Atty. Joshua Paul Capiral at nakababatang kapatid na si Christopher John kaugnay ng kasong paglabag ng Republic Act 3019 (Anti-Graft and Corrupt Practices Act) na inihain ni Jeffrey Dale Ignacio.
Unang pumutok ang pangalan ng nagreklamo matapos mabunyag ang Pastillas Scam sa Ninoy Aquino International Airport (NAIA) kung saan nag-ooperate ang sindikatong di umano’y kinabibilangan nito.
Bukod sa kasong graft, kinasuhan din ni Ignacio ang magkapatid na Capiral ng robbery extortion matapos di umano siyang hingan ng P200,000 kapalit ng legal services at pagpapa dismiss ng nakabinbin asunto sa Office of the Ombudsman.
Nag-ugat ang desisyon sa reklamong isinampa ni Ignacio laban sa magkapatid na Capiral sa paglabag ng RA 3019 na nagsasabing: “capitalizing on their respective public positions and official functions in the government, conspiring and confederating together, and mutually helping each other, did then and there, willfully, unlawfully, knowingly with manifest partiality and evident bad faith, cause undue injury to Ignacio by demanding money from him in the amount of P200, 000 in exchange for their legal services and the dismissal of his (Ignacio) criminal complaint lodged in the Office of the Ombudsman, to his damage and prejudice in the aforementioned amount of P200,000.”
Subalit sa desisyong lumabang kamakailan, ibinasura ng korte ang kasong graft matapos mabigo ang prosekusyon patunayan ang lahat ng elemento ng pagkakasala. Hindi makita ng korte sa testimonya ni Ignacio na may awtoridad o kakayahan ang magkapatid na Capiral na impluwensyahan ang Office of the Ombudsman kung saan nakabinbin ang kaso ni Ignacio.
“In the instant case, it was clearly set forth that the case where IO Ignacio was charged is pending with the Ombudsman, and there is no sufficient evidence to show that Atty. Capiral and IO Capiral, who are employees of the NBI and BI, respectively, had established connections with the Ombudsman, a different government agency, sufficient to influence the cases pending with the said office,” ayon sa korte.
“There would be no basis to discuss conspiracy between the accused Atty. Capiral and IO Capiral to determine their respective participation for there is no offense to speak of, in view of the failure of the prosecution to prove all the elements of the offense,” saad pa sa hatol na inilabas ng husgado.
“For the foregoing, this Court finds that the prosecutions failed to satisfy the standard proof beyond reasonable doubt for violation of Sec 3 of RA 3019. Wherefore, the judgment is hereby rendered acquitting Joshua Paul Capiral y Chua and Christopher John Capiral y Chua for violation of Sec. 3 (e) of Republic Act 3019, for failure of the prosecution to prove their guilty beyond reasonable doubt.”
“Accordingly, this case is dismissed,” dagdag nito.
Wagi rin ang magkapatid na Capiral sa kasong robbery extortion na rekalmo ni Ignacio matapos aprubahan ng Manila RTC ang Demurrer to Evidence na inihain abogado ng mga akusado.
Ayon sa pasya ng korte, bigo si Ignacio na ilahad ang pangyayari kung saan siya tinakot o napuwersa siyang magbigay ng pera at inamin din nito na hindi humingi ng pera ang mga akusado. Kinumpirma din ni Ignactio sa Korte na tinulungan siya ni Atty. Capiral na humanap ng ibang abogado sa kaso.
Para naman sa paglabag ng Code of Conduct and Ethical Standards for Public Officials and Employees, kinatigan rin ng husgado ang ang apela ni Capiral na ibasura ang desisyon ng Metropolitan Trial Court ng Manila, Branch 27.
“Accordingly, accused Joshua Paul Capiral is acquitted,” ayon ulit sa korte.
Sa desisyon, nakita ng Korte na inamin ni Ignacio na wala itong komunikasyon kay Atty. Capiral at nakausap lamang nito nang personal sa unang pagkakataon ang naturang abogado nang isagawa ang entrapment operation.
Inamin din ni Ignacio sa korte na nakahanap na siya ng abogado na ipinakilala ni Capiral at hindi na ginagamit ang serbisyo ng akusado sa kinasasangkutang kaso sa Ombudsman. (ESTONG REYES)
