SA sandaling maisabatas, susuklian ng danyos ang mga motoristang naabala bunsod ng mga paglabag na gawa-gawa lang ‘sa ngalan ng delihensya.’
Sa ilalim ng Senate Bill 1976 (Fair Traffic Apprehension Act), target ni Sen. Raffy Tulfo na bigyan ng proteksyon ang motorista laban sa modus operandi ng mga traffic enforcers dapat sana’y inaayos ang daloy ng mga sasakyan sa lansangan.
Para kay Tulfo, hindi biro ang perwisyong dulot ng maling panghuhuli sa mga motorista – nasayang na oras, nawalang pagkakataong kumita, nabulilyasong transaksyon at ang binayad na multa.
Kaya naman ang giit ng senador – panagutin ang mga abusadong traffic enforcers.
“Motorists experience tedious processes in contesting traffic apprehensions made against them, especially when the driver is under a no work, no pay policy. The bill seeks to provide compensation for drivers of motor vehicles who are wrongly apprehended for traffic violations,” saad sa isang bahagi ng panukalang nagsusulong ng ‘transparency’ at ‘accountability’ sa traffic enforcement system.
Sakop ng panukala ang operatiba ng Land Transportation Office (LTO), Metropolitan Manila Development Authority (MMDA), Land Transportation Franchising and Regulatory Board (LTFRB) at local government units (LGU).
“Any driver of motor vehicle apprehended by any traffic enforcement personnel may contest the traffic apprehension before the traffic adjudication board of the traffic enforcement authority to which the traffic enforcer belongs within 60 days from the date of apprehension or discovery of the same.”
Bahagi rin ng SB 1976 ang karapatan ng mga drayber na inabala na kumuha ng larawan o video sa panghuhuli ng mga traffic enforcers.
serbisyo ng Public Attorney’s Office (PAO) para sa gabay at pagtatanggol sakaling umabot sa husgado ang usapin sa trapiko.
“The driver is entitled to take a photo or video to record or document the traffic apprehension and use the photo or video as evidence before the traffic adjudication board…”
“Compensation is three times the amount as may be computed. If employed, the compensation is equivalent to the amount of daily wage multiplied by the number of times the driver took leaves of absence from work to contest the improper apprehension,” dagdag pa ni Tulfo.
“If unemployed, self-employed or with business, the compensation is equivalent to the prevailing minimum wage in the locality where the driver was apprehended, multiplied by the number of times the driver appeared before the traffic adjudication board to contest the improper apprehension,” giit pa ng bruskong senador.
Bukod sa danyos, puntirya rin niya ang pagsasampa ng kasong administratibo sa mga traffic enforcement personnel na nagkamali sa paghuli o dahilan ng paghuli.
